1. Acceptance of Terms
By accessing or using the Leap 4 Health platform, website, mobile applications, and related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.
These Terms constitute a legally binding agreement between you and Leap 4 Health. We reserve the right to modify these Terms at any time. Material changes will be communicated through the platform or by email. Your continued use of the Services after such notification constitutes acceptance of the updated Terms.
2. Eligibility
To use our Services, you must be at least 18 years of age, or have the consent of a parent or legal guardian. You must be physically located in a state where Leap 4 Health is licensed to provide telehealth services at the time of your consultation. You must provide accurate and complete information during registration and at all times during your use of the Services.
We currently provide services in Illinois, Arizona, California, Connecticut, Florida, Iowa, Kansas, Nebraska, Nevada, New Mexico, New York, South Dakota, and Washington. We may update this list as we expand our licensing.
3. Account Registration and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security.
You agree to provide truthful, accurate, and complete information when creating your account and to update your information as necessary. Providing false or misleading health information may compromise the quality of care you receive and may result in termination of your account.
4. Description of Services
Leap 4 Health provides telehealth consultations, AI-assisted health tools, prescription management, and related healthcare services through our platform. Our Services are designed for non-emergency medical care, including primary care, urgent care, chronic condition management, mental health support, weight management, and hormone health.
Important Limitations
- Our Services are not a substitute for emergency medical care. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately.
- Telehealth services are not a replacement for all in-person medical care. Your provider may refer you to an in-person specialist or facility when clinically appropriate.
- AI tools, including our symptom checker and care assistant, are designed to support -- not replace -- the clinical judgment of licensed providers.
- We cannot guarantee specific health outcomes. Treatment effectiveness varies by individual.
5. Telehealth Consent
By using our Services, you consent to receive healthcare services via telehealth technology, including video, audio, and asynchronous messaging. You understand that telehealth involves the electronic communication of your health information to providers who may not be physically present in the same location.
You acknowledge that telehealth has potential benefits, including improved access to care and convenience, as well as potential risks, including limitations in the ability to perform physical examinations, possible technology failures, and the small risk of unauthorized access to your information despite security measures.
You have the right to withdraw your consent to telehealth services at any time by notifying us in writing.
6. Prescriptions
Our providers may prescribe medications when clinically appropriate. All prescriptions are issued at the sole discretion of your treating provider based on their clinical judgment. You understand that not all consultations will result in a prescription.
Prescriptions are sent electronically to the pharmacy of your choice. You are responsible for providing accurate pharmacy information and for picking up and properly using prescribed medications. Certain medications, including some controlled substances, may not be available through telehealth services depending on state regulations and clinical appropriateness.
7. Payments and Billing
You agree to pay all fees associated with your use of the Services, including one-time visit fees and recurring membership fees. All fees are listed on our pricing page and are subject to change with reasonable notice.
Membership fees are billed on a recurring monthly basis. One-time visit fees are charged at the time of service. Payments are processed through our third-party payment processor. We accept major credit and debit cards, as well as HSA and FSA cards.
We do not currently accept insurance directly. We provide superbills that you may submit to your insurance provider for potential out-of-network reimbursement. We do not guarantee reimbursement from any insurer.
8. Cancellation and Refunds
You may cancel your membership at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period. No partial refunds are issued for unused portions of a billing period.
For one-time visits, refunds may be issued at our discretion if a provider has not yet reviewed your case. Once a provider has engaged with your case, the visit fee is non-refundable.
We reserve the right to suspend or terminate your account if you fail to pay applicable fees, violate these Terms, or engage in conduct that is harmful to other users or our platform.
9. Intellectual Property
All content, software, technology, designs, trademarks, and other intellectual property associated with the Services are owned by Leap 4 Health and its technology partner, Michai Media, or their respective licensors. You may not copy, modify, distribute, sell, or lease any part of our Services or included software without our written permission.
You retain ownership of any content you provide through the Services, such as messages and health information. By providing content, you grant us a limited license to use that content as necessary to deliver our Services and as described in our Privacy Policy.
10. Disclaimers
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any defects will be corrected. We do not guarantee any specific health outcomes from the use of our Services. Medical information provided through our AI tools is for informational and clinical support purposes and does not constitute independent medical advice.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LEAP 4 HEALTH, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND TECHNOLOGY PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.
Our total liability for any claim arising out of or relating to these Terms or the Services shall not exceed the amount you have paid to us in the twelve (12) months preceding the event giving rise to the claim.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles. Any legal action or proceeding arising out of these Terms shall be brought exclusively in the state or federal courts located in Cook County, Illinois.
13. Dispute Resolution
In the event of a dispute arising out of or relating to these Terms or the Services, you agree to first attempt to resolve the dispute informally by contacting us at support@leap4health.org. We will make reasonable efforts to resolve disputes within thirty (30) days.
If informal resolution is unsuccessful, either party may pursue binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration shall take place in the State of Illinois. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
14. Changes to These Terms
We may revise these Terms at any time by posting the updated version on our platform. The "Last updated" date at the top of this page indicates when the Terms were last revised. Material changes will be communicated through email or in-platform notification at least thirty (30) days before taking effect.
Your continued use of the Services after the effective date of revised Terms constitutes your acceptance of the changes.
